Teddy Bear Newfoundlands Mychelle Klose 446 Milton Street Nanaimo, BC Canada, V9R 2L1 250-797-2600 SAMPLE ONLY The parties to this Agreement, Of (hereinafter known as the Buyer) And Mychelle Klose of Teddy Bear Newfoundlands, Nanaimo, BC (herein known as the Breeder) 1.In consideration of payment in full of the purchase price of Dollars ($ ) in Canadian Funds by Buyer to Seller. Seller agrees to transfer to Buyer, subject to the terms and conditions contained in this contract, the ownership of one Male/Female Newfoundland puppy, herein referred to as the “Puppy”(regardless of age), from the mating of the sire and dam indentified below. Sire: Dam: 2. As soon as is reasonably possible after the puppy is eight weeks of age, Seller will make the Puppy available to be picked up by the Buyer, or Sellers will ship the Puppy to Buyer. Buyer will be responsible for all shipping expenses which shall be paid in advance of shipping. 3.The Breeder guarantees the Puppy to be a typical Newfoundland dog suitable as a pet and that to the best of her knowledge the puppy is in good health and free from any communicable disease. 4.The Breeder guarantees the Puppy against and crippling hereditary defect until the Puppy attains the age of one year. For the purposes of this agreement, a “crippling hereditary defect” is defined as any hereditary condition that renders the Puppy unable to function as a pet. 5.If, within its first year of life, the Puppy develops a crippling hereditary defect, the Buyer shall provide the Breeder with a statement from the examining Veterinarian verifying the condition of the Puppy. The Breeder may request that a Veterinarian of the Breeder’s choice examine the Puppy, or medical data, or both. If the Breeder agrees that the Puppy has developed a crippling hereditary defect, the Breeder shall replace the Puppy with one of equal value as soon as one becomes available to the Breeder, if in the meantime, the Buyer has returned puppy to breeder or breeder has agreed on puppy being euthanized. The Buyer shall give the Breeder an opportunity to have the Puppy evaluated by a Veterinarian of the Breeders choice before making any decision to euthanize the Puppy. Breeder shall be given the opportunity to have puppy returned. 6. Should you be unable to keep this puppy for any reason, the Buyer shall so notify the Breeder and shall offer the Breeder the first opportunity to take the Puppy back, or place it in a suitable home, or both. The Puppy’s registration papers and current transfer must be signed and accompany the Puppy. Transportation at the expense of the buyer unless otherwise arranged. We will always take in any puppy or dog that was purchased from Teddy Bear Newfoundlands and is in danger of not having a home. 7. The Buyer shall provide such protective vaccinations, boosters and veterinary care as may from time to time be required to ensure the well-being and good health of the Puppy. 8. Buyer agrees that the puppy will be confined in a fenced yard at appropriate times and will NEVER be chained as a method of permanent containment. It is generally agreed that chaining your pet is one thing that has the ability to change his temperament. 9. The Buyer agrees that at no time will the Puppy be turned over to the pound, humane society, pet store or animal shelter. 10. The Buyer shall provide the Puppy with sufficient quantities of good quality food suitable for a large breed dog and fresh water. 11. The Buyer shall provide sufficient exercise and training to ensure that the Puppy becomes a good companion and kept conditioned with good muscle tone. 12. All provisions of this agreement relating to the responsibilities and obligations of the Breeder shall become void if the ownership of the Puppy changes without the knowledge and consent of the Breeder. 13. The Puppy is sold under the restrictions of a Canadian Kennel Club Non-Breeding Agreement and, subject to paragraph 14 hereof, offspring from this puppy are not eligible for registration in any jurisdiction. 14. If the Buyer provides to the Breeder a written statement from a Veterinarian certifying that the Puppy does not have any hereditary defects at the age of two years, the Breeder may waive the restrictions of the CKC Non-Breeding Agreement, if in the opinion of the Breeder the Puppy is suitable for breeding. Puppy must be certified by either OFA, OVC, or GDC. 15. Neither the puppy nor any offspring from the Puppy shall be sold to, offered for sale or otherwise disposed of, through a pet shop, brokerage service, or dealer of dogs. 16. Under no circumstances shall the amount of liability on the part of the Breeder to the Buyer be greater than the purchase price of the Puppy. 17. The Breeder makes no warranties or guarantees either expressed or implied beyond those in this agreement. 18. This agreement constitutes the entire understanding between the BREEDER and the BUYER and shall supersede any and all previous understandings and agreements pertaining to the subject matter of this agreement. Any changes or amendments to this agreement shall be in writing and agreed to by both parties.
